Our film and television practice focuses on development, financing, and production of narrative and documentary films, television projects, and other audiovisual content. Our work includes production counsel services, as well as representation of independent producers and production companies, financiers, rights holders, talent, screenwriters, directors, and other creative and business participants. We bring practical, business-minded guidance to projects from development through production and delivery.
Our theatre and performing arts practice focuses on the development, financing, and production of Broadway, Off-Broadway, pre-Broadway, touring, and other live stage productions. Our work includes representation of producers and production companies, co-producers, investors, rights holders, bookwriters, composers, lyricists, directors, designers, performers, and other creative and business participants. Grounded in direct production experience, our approach reflects a practical understanding of what it takes to bring theatrical projects to life.
We consult during the development and production of documentaries and unscripted television projects, as well as narrative projects, to identify potential legal issues, including copyright infringement, defamation, false light, invasion of privacy, and related pre-publication concerns. Our clearance review includes a close assessment of third-party archival materials and whether their use may qualify as fair use under copyright law. Peter Mozarsky brings deep experience to this work, having spent several decades at HBO advising on these issues, including matters arising from newsgathering and production practices such as trespass, hidden cameras, secret audio recording, and ride-alongs. Throughout the process, we work closely with filmmakers and other creators to find practical and creative ways to mitigate legal risk while preserving the project’s integrity and artistic vision.
